Sotos LLP has joined forces with Siskinds LLP and Koskie Minsky LLP to request that the Canadian Bar Association (“CBA”) adopt a judicial protocol that creates a mechanism for the case management of multijurisdictional class actions.
The three firms’ submissions came in response to a Notice of Consultation on the CBA’s proposed “Canadian Judicial Protocol for the Management of MultiJurisdictional Class Actions and the Provision of Class Action Notice”.
The firms submitted to the CBA National Class Actions Task Force that the current state of affairs that effectively allows numerous duplicative multijurisdictional class actions defeats access to justice and drains judicial resources. “[T]he efficient management of multijurisdictional class actions is an imperative”, the firms submitted.
