The Manitoba government has announced that the Franchises Act will come into force on October 1, 2012. Although the Act was passed in June 2010, it has not yet been proclaimed.
As of October 1, franchisors in Manitoba will be required to comply with all of the requirements of the Act, which include new disclosure document obligations as well as a variety of “relational” provisions that will be read into every franchise agreement. The new law is similar but not identical to existing franchise laws in other provinces, and special Manitoba-specific considerations will need to be made in almost all cases. The province has also published the final regulations to the Franchises Act. The regulations can be downloaded here.
Franchisors doing business in Manitoba should prepare or update their franchise disclosure documents immediately to ensure that they are prepared for October 1.
