Divisional Court Dismisses Ontario Leave to Appeal

The Divisional Court has dismissed the Government of Ontario’s application for leave to appeal in the ongoing dispute between the province and the Ontario Motor Vehicle Licence Issuers Association.
In June, the Superior Court of Justice certified the licence issuers as a class, allowing the issuers to pursue their claim as a class proceeding. It was this decision that Ontario sought leave to appeal. In dismissing the application, Justice Sachs held that there was “no reason to doubt the correctness of the certification judge’s conclusion”.
